Nichia Corporation reportedly determined that LED-application products containing LEDs marketed by Wilmar Corporation (a U.S. marketing and distribution company) used white LEDs that infringe at least one of its U.S. patents. Nichia then demanded that Wilmar discontinue marketing the infringing products.
Nichia filed a patent infringement lawsuit in September 2010. Then in March 2011, Wilmar acknowledged patent infringement and agreed to stop marketing infringing products change to new products using non-infringing white LEDs. After Wilmar acknowledged patent infringement, an early settlement was reached, and the lawsuit is dismissed. Wilmar also agreed to purchase Nichia’s White LEDs as non-infringing products.
